Thursday, February 7, 2013 N/Warren Town and County News Page Eleven OFFICIAL PUBLICATION ATTACHMENT "A" ORDINANCE NO 13-04 AN ORDINANCE AMENDINGTHE CODE OF ORDINANCES OFTHE CITY OF NORWALK, IOWA, 2008, CHAPTER 135, BY ADDING SECTION 135 14 PERTAINING TO CAPITAL IMPROVEMENT PROJECTS COST SHARING BE IT ENACTED by the City Council of City of Norwalk, iowa: SECTION 1. SUBSECTION MODIRED. The Code of Ordinances of the City of Norwalk, iowa, 2008, Chapter 135 is modified by adding a section. Section 135.14, which reads as follows: 135.14 CAPITAL IMRPOVEMENT PROJECTS COST SHARING. When the City undertakes a capital improvement project involving street repair, reconstruc- tion or replacement and utility work, the cost of such improvements shall be shared by the City and the property owner. The property owner will be respon- sible for the cost of the improvements directly attributable and beneficial to the property, such as driveway approaches, home service lines, sidewalks, and curb and gutter.The City will bear the remainder of the cost of the project. A property on a corner lot will have its costs associated with the curb and gutter reduced by 30 percent on each side to compensate for having two frontages. SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3 SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
