The Regular City Council Meeting of the City of Cumming was held at Cumming
City Hall 649 N. 44t" St. on Monday, March 25, 2013. The Meeting was called to
Order at 7:00 P.M. by Mayor Tom Becker. Present at Roll Call: Dave Chelsvig,
Ed Harkin, Anita Enos,'Jean Lare. Absent: Peggy Koch. Motion made by Lare,
Seconded by Harkin to Approve the Agenda. Approved 4-0.
Public Comment Michael Hofland and Paul Richards regarding Apple Creek
plats 1 & 2 and sewer access

for the park will be ordered at the next meeting.
Action Items
A. Motion made by Lare, Seconded by Harkin to approve the Second Read-
ing of Ordinance 2013.01 - An Ordinance Amending the Code of Ordinances
of the City of Cumming, iowa by Amending Provisions Pertaining to Chapter 136
of the Code of Ordinances, Cumming, Iowa Sidewalk Regulations. Approved 4-
0.
B, Mowing bids were discussed, then a Motion was made by Enos, Sec-
onded by Lare to approve Resolution 2013-15 Approving and Authorizing Ex-
ecution of an Agreement for Mowing of Public Lands for the City of Cumming
with Ford Lawn and Paint. Approved 4-0.
C. Motion by Enos, Seconded by Chelsvig to approve Resolution 2013-16
Disposal of Public Property. Approved 4-0.
D. Motion by Harkin, Seconded by Enos to approve Sprint adding new an-
tennas/removing old antennas on the water tower. Approved 4-0.
E. Bid on new stairs and deck maintenance was tabled until next meeting.
F. Bid on drainage was tabled until next meeting.
G. Motion by Enos, Seconded by Lare to approve Clerk's attendance at Iowa
Spring User Group meeting. Approved 4-0.
H. Motion by Chelsvig, Seconded by Enos to approve purchasing 200 koozies
from Park and Rec for the Commercial Real Estate Trends Breakfast on 4/10/13.
Approved 4-0.
I. Discussion took place on the alley running east(west between N. 43'd and
44= atWagnerlOIlinger/Sweeney property.Tom Becker wiU address the problem
with the homeowners.
J. Motion by Enos, Seconded by Cheisvig to table recommendation from
Planning and Zoning to update the Cumming Code of Ordinances 157.03 to be
consistent with the language of Statewide Urban Desi~]n and Specifications
(SUDAS). until further clarification can be obtained. Approved 4-0.
Discussion Items
Sewer access for Apple Creek plats 1,2 & 3 was discussed. The Clerk will
contact the City Engineer to set up a meeting with the land owners and the City
Attorney to discuss the specifics of having the sewer put in by the City, but reim-
bursed by the land owners.
The Garbage/Recycling Request for Proposal (RFP) was discussed.
The Mayor appointed Dave Chelsvig, Anita Enos and the Clerk to the com-
mittee to review the garbage/recycling bids and excess water capacity bids. A
member from Park and Recreation and Planning and Zoning will also be in-
cluded on the committee.
At least 3 bids will be obtained to redo the floors in city hall.
Ads will be placed in the Norwalk paper for upcoming vacancies on the
Park & Rec Board and Planning and Zoning. Males are needed for both boards
due to gender balance laws.
Informational Items
The casino referendum in Warren County will be on May 7th. A town hall

open house wm take place on March 28 from 5-8 pm at The Wnght Place m
Norwalk.
Ed Harkin will look into getting bids from Steffes Construction for road re-
pair and from Gary Wiedmann for the drainage issue

Public Notice:
The City of Norwalk, a Municipal Separate Storm Water Sewer System (MS4)
permit holder, will hold a Storm water Pollution Prevention Workshop on April
30, 2013 at 6:00 RM. at the Norwalk City Hall Council Chambers, 705 North
Avenue, Norwalk, Iowa.
This workshop is for the education of Developers, Builders, Consultants and
Residents concerning ways in which Developments & Construction sites may
be designed to improve water quality.

REGULAR COUNCIL MEETING 4-04-13
The Regular City Council Meeting of the Norwalk City Council was held at the
Norwalk City Hall, 705 North Avenue, on Thursday, April 4, 2013. The meeting
was called to order at 6:30 P.M. by Mayor Doug Pierce. Those. present at roll call
were Dave Murillo, Mike Leto, Jamie Sylvester and Eric Delker. Absent: Frank
Curtis.
13-061 Motion by Murillo and seconded by Delker to approve the Agenda.
Motion carried unanimously,
Greenfield township trustee, Galen Bedwell, is interested in Norwalk Fire De-
partment covering a portion of the Township. North Warren Fire is the current
fire department for all of Greenfield Township. Lori Atkinson, 1919 Merle Huff,
expressed concerns that city residents would be paying more for FirelEMS ser-
vices then rural township residents. Greenfield township trustee chairman, Skip
Phillips, stated not all township residents want to change from the current cover-
age.
13-062 Motion by Delker and seconded by Sylvester to approve the Minutes of
the March 7,2013 Regular Council meeting. Motion carried unanimously.
The mayor welcomed those guests present. The public portion of the meeting
was opened.
City Attorney, Jim Dougherty, informed those in attendance that the Council and
City staff do not answer questions or take action on any topics during this portion
of the Agenda.
Approximately 30 citizens comprised of Norwalk residents, primarily from the
Lakewood and Cumming annexed areas, along with Warren County residents
and interested parties from outside of the area, spoke at this time inforrfiing the
City Council they do not support the idea of a casino being constructed in Norwalk.
City Manager, Marketa Oliver, reminded the room about the City's Community
Chats that are held the second Saturday of each month as public forum opportu-
nities to discuss With staff and councilors.

making changes to the Community Development fees. (second of three read-

13-065 Motion by Leto and seconded by Sylvester to pass a proposed Ordi-
nance amending the Code of Ordinances of the City of Norwalk, low'a, 2008,
Chapter 136, pertaining to removal of snow, ice and accumulations from
public sidewalks (second of three readings) Approved 4-0. Ayes: Mudllo, Leto,
Sylvester and Delker. Nayes: none.
13-066 Motion by Sylvester and seconded by Delker to pass a proposed Ordi-
nance amending Chapter 177 of the Cede of Ordinances of the City of
Norwalk, Iowa, 2008 making changes to the EMS fees. (first of three read-
ings) Approved 4-0. Ayes: Murillo, Leto, Sylvester and Delker. Nayes: none.
13-067 Motion by Murille and seconded by Delker to pass a proposed Ordi-
nance amending theCode of Ordinances of the City of Norwalk, Iowa, 2008,
by amending Chapter 177 pertaining to Building Department Permit fees.
(first of three readings) Approved 4-0. Ayes: Murillo, Leto, Sylvester and Delker.
Nayes: none.
13-068 Motion by Delker and seconded by Murillo to adopt a Resolution ap-
proving the Preliminary Plat for the Legacy Circle Villas (Resolution No.
0404-13-022) Approved 4-0. Ayes: Murille, Leto, Sylvester and Detker. Nayes:
none.
13-069 Motion by Delker and seconded by Leto to adjourn the meeting. Mo-
