AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF NORWALK, IOWA, 2008, BY AMENDING CHAPTERS 164 AND 177 PER-
TAINING TO COMMUNrI'Y DEVELOPMENT APPLICATION FEES
BE IT ENACTED by the City Council of the City of Norwalk, Iowa:
SECTION 1. SECTION MODIFIED. Section 164.07 of the Code of Ordinances
of the City of Norwalk, Iowa, 50211, is modified to read as follows:
7.07 PERMIT APPLICATION FEES. Applications submitted to the City for
certificates of occupancy, driveway curb cut permit, sidewalk permit, deck per-
mit, demolition permit, driveway approach permit, fence permit, permanent pool
permit, seasonal pool permit, accessory structure permit, excavation permit,
construction trailer, cell tower addition and administrative fee's shall be accom-
panied by an application fee as established in Chapter 177 of this Code of Ordi-
nances.
SECTION 2. SECTION MODIFIED. Subsection 28 of Chapter 177 of the Code.
of Ordinances of the City of Norwalk, Iowa, 50211, is modified to read as follows:

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF NORWALK, IOWA, 2008, BY AMENDING CHAPTER 136, PERTAINING
TO REMOVAL OF SNOW, ICE, AND ACCUMULATIONS
BE IT ENACTED by the City Council of the City of Norwalk, Iowa:
SECTION 1. SECTION MODIFIED. Section 136.03 of the Code of Orclinances
of the City of Norwalk, Iowa, 50211, is repealed and the following adopted in lieu
thereof:
136.03 REMOVAL OF SNOW, ICE AND ACCUMULATIONS. It is the re-
sponsibility of the abutting property owners to remove snow, ice and accumula-
tions promptly from sidewalks. If a property owner does not remove snow, ice or
accumulations within twenty-four (24) hours, the City may do so and assess the
costs against the property owner for collection in the same manner as a property,
tax.
SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall
not affect the validity of the ordinance as a whole or any section, provision or
part thereof not adjudged invalid or unconstitutional.
SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and
after its final passage, approval and publication as provided by law.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY
OF NORWALK, IOWA, CHAPTER 177 - RATES AND FEES, BY AMENDING
EXISTING SECTION 177.22, BY AMENDING THE FEE STRUCTURE FOR
BUILOING PERMIT APPLICATIONS
BE IT ENACTED by the City Council of the City of Norwalk, Iowa:
SECTION 1. SECTION M(DIFIED. Section 177.22 of the Code of Ordinances
of the City of Norwalk, Iowa, Chapter 155 - BUILDING CODE, is repealed and
the following adopted in lieu thereof:
177.22 CHAPTER 155 - BUILDING CODE. Building permits shall be
charged a fee based on a Permit Fee Multiplier formula. The building permit fee
to be charged equals Gross Floor Area times Square Foot Construction Cost
times Permit Fee Multiplier, The permit fee multiplier for the City shall be .0052.
The square foot construction cost shall be in accordance with the Interna-
tional Code Council's February 2012 Square Foot Construction Costs table.
SECTION 2. REPEALER. All ordinances or p&rts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional such adjudication shall
not affect the validity of the ordinance as a whole or any section, provision or
part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect 1tom and
after its final passage, approval and publication as provided by law.

REGULAR COUNCIL MEETING 4-18-13
The Regular City Council Meeting of the Norwalk City Council was held at the
Norwalk City Hall, 705 North Avenue, on Thursday, April 18, 2013. The meeting
was called to order at 6:30 P.M. by Mayor Doug Pierce. Those present at roll call
were Dave Murillo, Mike Leto, Jamie Sylvester and Frank Curtis. Absent: Eric
Delker.
13-070 Motion by Curtis and seconded by Leto to approve the Agenda as
amended to move 8A approval to waive the $50 special events application
fee for RuNorwalk to the consent agenda item 61 =. Motion carried unani-
mously.
13-071 Motion by Sylvester and seconded by Leto to approve the Minutes of
the April 18, 2013 Regular Council meeting. Motion carried unanimously.
The mayor welcomed those guests present. The public portion of the meeting
was opened with no one wishing to speak. With none forthcoming, the business
portion of the meeting was opened.
The Consent Agenda includes tax abatement applications; special events per-
mit - RuNorwalk; set June 8, 2013 as the date of-the soap box derby; monthly
department head reports; waiver of $50 special events application fee for

nance amending the Cede of Ordinances of the City of Norwalk, Iowa, 2008
making changes to the Community Development fees. (Ordinance No. 13-
06) Approved 4-0. Ayes: Murillo, Leto, Sylvester and Curtis. Nayes: none.
13-074 Motion by Murillo and seconded by Leto to pass a proposed Ordi-
nance amending the Code of Ordinances of the City of Norwalk, Iowa, 2008,
Chapter'136, pertaining to removal of snow, ice and accumulations from
public sidewalks. (Ordinance No. 13-07) Approved 4-0. Ayes: Murillo, Leto,
Sylvester and Curtis. Nayes: none.

13-076 Motion by Curtis and seconded by Leto to pass a proposed Ordinance
amending the Code of Ordinances of the City of Norwalk, lewa, 2008, by
amending Chapter 177 pertaining to Building Department Permit fees. (sec-
ond of three readings) Approved 4-0. Ayes: Murillo, Leto, Sylvester and Curtis.
Nayes: none.
The next item on the agenda is discussion regarding proposed gaming referen-
dum and proposed construction of a casino, hotel, events center and bowling
alley in Norwalk.
Susan Geddes was present to read a statement from Wild Rose to address
some concerns including how Wild Rose was approached and potential location
for the project. Each councilmember stated they are listening to all concerns,
researching facts and awaiting the results of Norwalk voters on May 7, 2013.
The following residents stood to share publicly their opinion: Pat Ashbaugh, Tom
Greteman, Jackie Livingston, Rick Hardy, Dave Hixenbaugh, Tom Coates, Matt .
Van Dyke, Brennan Buckley, Christy Fox, Ben Elliott, Andrew Johnson, Bob
Ashbaugh, Lisa Neber and Erika Isley spoke against the project or the proposed
location. Jared Starkweather, Newton Standridge and Gary Randa spoke in fa-
vor of the project.
