The following business was had to-wit: SIMPLE MOTION by Doug Shull, seconded by Marvin Grace to approve the agenda for April 6, 2010 as presented. Carried unanimously. SIMPLE MOTION by Marvin Grace, second by Doug Shull to approve the 2 sets of March 16, 2010 board minutes as presented. Carried unanimously. RESOLUTION 10-87 CLOSE PUBLIC HEARING BE IT RESOLVED THAT, the public hearing regarding the budget amendment is hereby closed. Carried unanimously. RESOLUTION 10-88 APPROVE BUDGET AMENDMENT BE IT RESOLVED THAT. The Warren County board of Supervisors hereby ap- proves the budget amendment for fiscal year 2009-2010 as presented. Carried unanimously. RESOLUTION 10-89 APPROVE APPROPRIATIONS BE IT RESOLVED THAT, the appropriation changes corresponding to the bud- get amendment are hereby approved for fiscal year 2009-2010 as presented. Carried unanimously. Carried unanimously RESOLUTION 10 - 91 BUDGET APPROPRIATION WHEREAS, on June 16, 2009 the Board of Supervisors approved appropriating 97% of the total budget to the various departments; NOW BE IT RESOLVED THAT, the remaining 3% unappropriated budget for the Information Technology department of $12,676 be approved for the fiscal year ending June 30, 2010. Carried unanimously. RESOLUTION 10 - 92 BUDGET RE-APPROPRIATION BE IT RESOLVED THAT, there be the following re-appropriation for the fiscal year ending June 30, 2010: From To General Services $6,500 Information Technology$6,500 Carried unanimously. RESOLUTION 10 - 93 APPROVE FIREWORKS PERMITS BE IT RESOLVED THAT, the applications for fireworks permits received from August Wright for July 3 r with rain dates being July 4 th or July 10 t" and Martin Wells for July 1st through July 17 t" are hereby approved. RESOLUTION 10 - 94 AUDITORS OFFICE NEW HIRE BE IT RESOLVED THAT, the Warren County Board of Supervisors hereby ap- prove the hiring of Robin Buthmann in the Auditor's Office as a full-time Clerk, effective April 26, 2010 at $14.50 per hour with a 3% increase after a satisfac- tory 6 month review, with full benefits. RESOLUTION 10 - 95 APPROVE APRIL 27 TM LUNCH N LEARN BE IT RESOLVED THAT, the Lunch n Learn request, to be held April 27, 2010, for use of the Board Room and expenditure for Subway Foot long sandwiches along with $300 for the presenter's is hereby approved at a cost up to $750 from Live Healthy Iowa. RESOLUTION 10 - 96 APPROVAL AND INSTALLATION OF NEW ENTRANCES BE IT RESOLVED THAT the following policy be established regarding the instal- lation of new entrances on the Secondary Road System: 1 .No entrance or access shall be permitted in the Secondary Road right of way without the approval of the County Engineer. 2. Any agricultural entrance requests that exceed four in one-quarter mile or any residential entrance requests that exceed two per parcel are not readily approvable by the Engineer's Office and said applications must.be brought before the Board of Supervisors for approval/disapproval. Also, when a second entrance is re- quested within 200 feet (centerline to centerline) of an existing entrance, it is not readily approvable by the Engineer's Office. 3. A new entrance must have a minimum sight distance of 500' on unpaved roads and 600' on paved roads, in each direction, based on the height of the driver's eye equal to 3.5 feet (in accordance with Chapter III of the most current publication of "A Policy on Geometric Design of Highways and Streets" prepared by AASHTO). 4. All pipe culverts must be new corrugated metal pipe with a minimum diameter of 15", (or the diameter determined by the Engineer's Office), and minimum length of 30', and must be purchased by the property owner. 5. The Design Aids Table in DOT's Instructional Memorandums to County Engineers 3.210, shows cross-slopes of 6:1 on entrances located along paved Farm to Market roads with less than 1,500 vehicles per day. It shows 8:1 cross- slopes (taper to 6:1 at the culvert per Standard Road Plan RL-7) on entrances when the current ADT is over 1,500. Warren County's latest available traffic count map shall be used in determining required slopes. 6. The entrance shall be installed in accordance with current Warren County standards for installation of access ways. 7. The applicant is responsible for determining the location of any underground utilities and protecting them. 8. Granular surfacing or paving is the responsibility of the property owner. 9. Private roads in a rural subdivision are the responsibility of the property own- ers within the subdivision and no accesses shall be permitted to a Local Sec- ondary Road adjoining a subdivision when the lot in the subdivision has access to a private road within the subdivision or a paved street within the subdivision. RESOLUTION 10 - 97 ISSUANCE OF OVERSIZE/OVERWEIGHT PERMITS WHEREAS, the Board of Supervisors is empowered under authority of Section 321E.1 of the Code of Iowa to issue permits for the movement of machines, vehicles or loads, or combination "thereof which exceed the maximum dimen- sions and/or weights specified in Section 321.452 to 321.467 but within the limi- tations of Chapter 321 E upon Secondary Roads under their jurisdiction; and, WHEREAS, it is important that such permits be issued by persons familiar with the statutes and regulations relating to such permits and also with the limitations of the County's roadways, road surfaces and structures along the selected or designated routes; now, BE IT RESOLVED that once a current, valid certificate of insurance in the amount of not less than $500,000 is received, and once any and all critical structures have been evaluated (with said evaluations being paid by the individual/com- pany applying for the permit), that the Warren County Engineer be authorized to issue and sign special permits for the movement of machines, vehicles or loads of excessive size and weight upon Warren County Secondary Roads in accor- dance with said Chapter 321 E. Grace-Aye, ShulI-Aye, Middleswart-Absent. RESOLUTION 10 - 98 GRANULAR SURFACING AT SCHOOL BUS TURNAROUNDS WHEREAS, the various school districts in Warren County have numerous loca- tions where school buses turn around in county road right of way; and, WHEREAS, these bus turnarounds often need the addition of granular surfacing material; now, BE IT RESOLVED the following policy be adopted in regard to school bus turn- arounds: "A maximum of two (2) eight (8) ton loads of granular surfacing material will be placed within the road right of way on designated entrances for school bus turn- arounds, when the entrance is in need of surfacing material and is verified as a bus turnaround by the Superintendent of the School District or the Transporta- tion Director. RESOLUTION 10 - 99 SALE OF USED MATERIAL WHEREAS, Warren County has used bridge lumber and pipe culverts in main- tenance and construction operations which are not reusable; and, WHEREAS, many residents of Warren County are interested in purchasing this used material; now, BE IT RESOLVED, that used bridge lumber and pipe culverts that are in such condition that it is not feasible for Warren County to reuse said material in its construction and maintenance operations, that the County Engineer or his des- ignee may sell said used material available to residents of Warren County with payment to be made by check to the Warren County Engineer and credited to the Secondary Road Fund. RESOLUTION 10 - 100 GRANT & PERMIT FORM WHEREAS, as provided in Section 319.14 of the Code of Iowa, whereby a per- son shall not excavate or fill or make any physical change within the right of way of public road or highway without obtaining a permit from the highway authority having jurisdiction of such public road or highway, and any work performed un- der the permit shall be performed in conformity with the specifications prescribed by the highway authority; and, WHEREAS, Warren County has adopted a "Grant and Permit" form, including specifications for performance of the said work, including the filing of a cash bond to insure compliance with the said specifications; now, BE IT RESOLVED, on a motion by Doug Shull, second by Marvin Grace: 1. That the amount of each bond to be posted with the "Grant and Permit' Application be established as follows: Trenching the full width of a paved road $1000 cash bond Trenching half the width of a paved read $500 cash bond Boring under a paved road $250 cash bond Trenching on an unpaved road $1.50 per lineal foot Note: A cashier's check may be submitted in lieu of cash For any private utility placed in highway or street right of way. 2. That the applicant shall be the owner of the proposed improvement; 3. That the applicant is responsible for determining the location of any under- ground utilities and the protection of all nearby utilities. Grace-Aye, Shuli-Aye, Middleswart-Absent. RESOLUTION 10 - 101 SET A SCALE FACTOR FOR PURPOSES OF RIGHT-OF-WAY LAND ACQUI- SmONS WHEREAS, in determining compensation, if any, for Right-of-Way needed for read purposes, the assessed valuation established by the Warren County As- sessor and the Iowa Farm & Land Chapter #2 Realtors Land institute "Farmaod Value Survey" File C2-75 dated March 2010 for the South Central Area have been used in arriving at a scale factor; and, land sales in Warren County, for the year 2009, have been recorded and the sale price per acre has been compared to the assessed valuation per acre to establish a scale factor; now, , SCALE FACTOR, the scale factor of  times the assessed valuation for agricultural land; the scale factor of 12.74 times the assessed valuation for plat- ted lots less than 20 acres, Class A; and the scale factor of 2.07 times the as- sessed valuation for developed lots less than 20 acres, Class R, be established for the 2010 calendar year for all right of way purchased for road purposes.
