The meeting was called to order at 6:00 P.M. by Mayor Doug Pierce. Those present at roll call were Dave Murillo, Frank Curtis, Eric Delker and Mike Leto. Absent: John Putbrese. 10-149 Motion by Leto and seconded by Munllo to approve the Agenda. Ap- proved 4-0 Ayes: Murillo, Curtis, Delker and Leto. Nayes: none. Absent: Putbrese. 10-150 Motion by Delker and seconded by Murillo to approve the Minutes of the May 20, 2010 Regular Council meeting. Approved 4-0. Ayes: Murillo, Curtis, Delkerand Leto. Nayes: none. Absent: Puthrese. The mayor welcomed those guests present. The public portion of the meeting was opened with no one wishing to speak. Maypr Pierce closed the Public Hearing. 10-157 Motion by Putbrese and seconded by Curtis to adopt a Resolution accepting the voluntary annexation request for the Norwalk Public Works Facility. Approved 5-0. Ayes: Muritt0, Putbrese, Curtis, Delker and Leto. Nayes: none. (Resolution #0603-10-37)_ 10-158 Motion by Putbrese and seconded by Murillo to approve an Emergency Services Management Contract between the City of Norwalk and Kelly Willis for the amount not to exceed $12,800, pending City Attorney review. Ap- proved 5-0. Ayes: Muriilo, Putbrese, Curtis, Delker and Leto. Nayes: none. 10-159 Motion by Curtis and seconded by Leto to table approval to secure professional fund raising services for the Norwalk Community Recreation Center project. Approved 5-0. Nayes: none 10-160 Motion by Curtis and seconded by Putbrese to table approval of a vehicle purchase and exchange between Development Services and the Police Department. OFFICIAL PUBLICATION PUBLIC NOTICE OF STORM WATER DISCHARGE WARREN COUNTY FAIR ASSOCIATION plans to submit a Notice of Intent to the Iowa Department of Natural Resources to be covered under the NPDES General Permit, General Permit No. 2 "Storm Water Discharge Associated with Industrial Activity for Construction Activities." City Council of the City of Norwalk, Iowa, that: SECTION 1. Pursuant to published notice and following public hearing on the 6~ day of May, 2010, so required by Sections 362.3 and 380.8, Code of Iowa, there is hereby adopted by the City of Norwalk, Iowa, the "CODE OF ORDINANCES OF THE CITY OF NORWALK, IOWA, 2010." SECTION 2. All of the provisions of the "CODE OF ORDINANCES OF THE CITY OF NORWALK, IOWA, 2010," shall be in force and effect on and after the effective date of this ordinance. SECTION 3. All ordinances or parts thereof in force on the effective date of this ordinance are hereby repealed from and after the effective date of this ordinance, except as hereinafter provided. SECTION.4. The repeal provided for in the preceding section of this ordinance shall not affect any offense or act committed or done or any penalty or forfeiture incurredor any contract or dght established or accruing before the effective date of this ordinance; nor shall such repeal affect any ordinance or resolution premising or guaranteeing the payment of money by the City or authonzing the issuance of any bonds of said City or any evidence of said City's indebtedness or any contract or obligation assumed by said City; nor shall said repeal affect the administrative ordinances or resolutions of the Council not in conflict or inconsistent with the provisions of "THE CODE OF ORDINANCES OF THE CITY OF NORWALK, IOWA, 2010"; nor shall it affect the following ordinances specifically saved from repeal: URBAN RENEWAL AREAS ADOPTED ORDINANCE NO. (_Ordinance #10-03) 10-153 Motion by Curtis and seconded by Delker to pass proposed Ordinance an~nding the Cit~ of Norwalk Municipal Code by amending Chapter 17.40 provisions pertaining to the surface requirements of off-street parking and loading. (3'~ reading) Approved 4-0. Ayes: Murillo, Curtis, Delker and Leto. Nayes: none. Absent: Putbrese. (Ordinance#10-04~ 10-154 Motion by Curtis and seconded by Murillo to pass proposed Ordinance providing for increased water rates and increased sewer rates, amending section 13.18.050(B) and 13.04.391 of the Norwalk Municipal Code. (3'd reading) The sewer base rate will increase $.75 to $3.00 per month and the usage rate wilt increase 5.4% to $6.25, the water usage rate will increase 5.0% to $3.84. New rates will be in effect and reflected on the June utility bills due. Approved 4-0. Ayes: Mudllol Curtis, Delker and Leto. Nayes: none, Absent: Putbrese. Mayor Pierce opened the Public Hearing adopting a Resolution to accept the voluntary annexation for the Wastewater Treatment Facility. With no discussion or comments, Mayor Pierce closed the Public Hearing. 10-156 Motion by Putbrese and seconded by Leto to adopt a Resolution ac- cepting the voluntary annexation request for the WRA project. Approved 5- 0. Ayes: Murillo, Putbrese, Curtis, Delker aed Leto. Nayes: none. Mayor Pierce opened the Public Hearing for a proposed Ordinance adopting a Resolution to accept the voluntary annexation for the Public Works Facility. Ted Phillips, 7855 Coolidge and Galen Bedwell, 7804 G 14, spoke with concems SECTION 6. An official copy of the "CODE OF ORDINANCES OF THE CITY OF NORWALK, IOWA, 2010," adopted by this ordinance, including a certificate of the City Clerk as to its adoption and the effective date, is on file in the office of the City Clerk, and shall be kept available for public inspection. SECTION 7. The City Clerk shall furnish a Copy of the =CODE OF ORDINANCES OF THE CITY OF NORWALK, 10WA, 2010," to the Judicial Magistrates sewing the City of Norwalk. SECTION 8. This ordinance shall be in full force and effect from and after the publication of this ordinance, as required by law.
