The Courts Redefine Marriage
Males and Females for centuries have entered into a
relationship with each other to procreate and raise the
next generation of human beings. That relationship was
called a marriage. Everyone knew what a marriage was.
In recent years the definition of marriage has been
changed, mostly through court cases, to mean a rela-
tionship between any two people, giving them the rights
and prestige of a marriage. The U.S. Supreme Court and
the Iowa Supreme Court have ruled that the U.S. Con-
stitution and the Iowa Constitution, provide that it is
unconstitutional not to define marriage as induding a
relationship between people of the same gender, as well
as a male and female. The basis for the rulings, they say,
is the clause of the Constitutions that guarantees due
process and equal rights, to all. I don't believe that any-
one would seriously argue that the people who wrote
and ratified our federal and state constitutions, and the
amendments thereto, intended to change the definition
of marriage to include same gender relationships. That
idea did not occur to anyone until recent years.
Both the federal and state constitutions contain
amendment provisions. However, both courts claim the
right tO change the constitutions in light of changing
societal points of view, as determined by them. I know
that it is very difficult for those who agree with the re-
sults of the court opinions to oppose allowing the courts
to exercise this power. However, it should be obvious
that a majority of a court, five judges at the federal level
or four here in Iowa, may in the future make rulings
that those who support the current rulings, do not sup-
port. Amending constitutions was intentionally made
difficult so they would not be amended casually. A1-
lowing courts to in effect amend constitutions means
we really do not have constitutions. Constitutions are
supposed to contain rights and protections that cannot
be easily changed. Under the current judicial practices
the meaning of a constitution can be changed at any time
by a court, when activists bring a case before it, as has
happened more than once in recent years.
The obvious question is what is the remedy for run-
away courts legislating in this fashion? Under present
political conditions there is no clear remedy. A presi-
dent can appoint judges with different legal philoso-
phies, but Obama would not do that. Iowa's governor
can only select judges from a group recommended to
him by a nominating commission. Legislative bodies
could act but there is no clear majority at the state or
federal level to do so. Also, Obama could veto legisla-
tion at the federal level. Perhaps the next president will
appoint judges who are able to set aside their personal
opinions and interpret the law as intended by those who
enacted it. Judges that assert the power to change our
constitutions and laws according to their personal phi-
losophies, should be a concern to all of us.
It seems to me that more tests are needed before we
go further in legalizing these products
