Regular Council Meeting 6/27/2016

The Regular City Council Meeting of the City of Cumming was held at Cumming
City Hall 649 N. 44th St. on Monday, June 27, 2016.The meeting was called to
Order at 7:00 P.M. by MayorTom Becket. Present at Roll Call: Ed Harkin, Peggy
Koch, Jean Late, Dave Chelsvig, Dino Goode. Absent: None. Motion made by
Goode, Seconded by Harkin to Approve the Agenda. Approved 5-0.
Public Hearing Amending the Code of Ordinances - Chapter 165 Subdivision
Regulations and Chapter t 70 Zoning Regulations was opened at 7:01 pm. No
public or written comments were received. Public hearing was closed at 8:50
pm.
P~,rk & Rec: A piece of new equipment was ordered; street dance has been put
on hold due to not enough volunteers; looking at a cover/building for the pop
machine; looking at buying something to haul water in for plants.

work with the attorney for Randy Archer regarding the berm and plantings pro-

B. Motion by Late, Seconded by Chelsvig to amend Chapter 170.14, 170.16,
170.18, 170.21,170.23 prior to the first reading of Ordinance 2016-01 Chelsvig,

C. Motion by Goode, Seconded by Koch to amend Chapter 170.12 and 170.13
prior to the first reading of Ordinance 2016-01. Approved 5-0

E. Discussion was held on amending the Land Use Plan and Great Western
Crossing PUD
F. Motion by Chelsvig, Seconded by Goode to approve Resolution 2016-18
Set a date for a Public Hearing on Amending the Land Use Plan and Great
Western Crossing PUD. Approved 5-0.
G. Updates were given by the City Engineer on N. 35th Street erosion issues,
Phase 2 Sewer Project, Blue Heron Cimle Pavement Rehabilitation.
H. Motion by Lare, Seconded by Chelsvig to approve Resolution 2016-19 Blue
Heron Circle PCC Pavement Rehabilitation - Approve Preliminary Plans and
Setting a Date for Hearing and Letting. Approved 5-0.
I. Motion by Harkin, Seconded by Lare to direct the City Attorney to start pro-
ceedings to vacate the alley owned by the City west of the American Legion
Building. Approved 5-0.
J. Motion by Goode, Seconded by Harkin to approve payment of $100 for use
of outside venues. Approved 5-0.
K. Discussion was held on the Economic Development Coordinator Position.

Notice is hereby given that a public
hearing will be held before the WAR-
REN COUNTY ZONING COMMIS-
SION on the 18th day of July, 2016
at 6:40 p.m. in the 2nd floor Board
of Supervisors Mestlng Room, War-
ren County Administration Building,
Indlanola, Iowa.
Said hearing is in regard to proposed
amendments to the 2015 Warren
County Iowa, Revised Zoning and
Subdivision Ordinances. The
amendment application is made by the
Warren County Zoning Administra-
tor. The first proposed amendment is
in Chapter 46, SUBDIVISION REGU-
LATIONS, Section 46.12 IMPROVE-
Delete: 1.
Bond. Then add following wording to:
or a set-aside letter of credit from a
bank, to the fourth, fifth, and seventh
lines of the paragraph. Add the follow-
ing wording to the tenth line of the para-
graph: or the set-aside letter of credit
from a bank. It will now read as fol-
lows:
1. Before the final plat of any area
shall be approved by the Board of Su-
pervisors and recorded, the subdivider
shall make and install the improve-
ments described in this section. In lieu
of final completion of the minimum im-
provements before the plat is finally
approved, the subdivider shall post a
bond or a set-aside letter of credit from
a bank, approved by the County Attor-
ney and County Treasurer, with the
Board of Supervisors, which bond or
a set-aside letter of credit from a bank
will insure to the County that the im-
provements will be completed by the
subdivider within one (1) year after fi-
nal approval of the plat. The amount
of the bond or a set- aside letter of
credit from a bank shall not be less
than the estimated cost of the improve-
ments and the amount of the estimate
must be approved by the County En-
gineer. If the improvements are not
completed within the specified time,
the County may use the bond or the
set-aside letter of credit from a bank
or any portion thereof to complete
same. For plats located in unincorpo-
rated areas within two (2) miles of the
corporate limits of cities that have
adopted the provisions of Section
354.9 of the Code of Iowa, the Com-
mission and Board may waive the re-
quirements of this section provided
they are satisfied that the subdivision
regulations of the City governing the
areas within which the subdivision is
located are sufficient to insure ad-
equate conformance with these regu-
lations.
The second proposed amendment is
in Chapter 46, SUBDIVISION REGU-

MENTS REQUIRED. 4.Warranty. Add
the wording: or a set-aside letter of
credit from a bank to the fourth line.
Delete the wording: or other accept-
able collateral. It will now read as fol-
lows:
4. Warranty. The subdivider shall be
responsible for the installation and/or
construction of all improvements re-
quired by this chapter, and shall war-
rant the design, materials and work-
manship of such improvements, instal-
lation and construction for a period of
two (2) years from and after comple-
tion. Such warranty shall be by bond
or a set-aside letter of credit from a
bank; and shall be subject to review
by the County Attorney; shall assure
the expedient repair or replacement of
defective improvements under war-
ranty; and shall indemnify the County
from all costs or losses resulting from
or contributed to such defective im-
provements.

Baseball: The Warriors begin the week with an over-
all record of 15-14 and have completed their Little
Hawkeye Conference schedule with a 9-9 record.
Norwalk will now complete their regular season sched-
ule and then focus on post season play a week from Fri-
day.
Softball: The Warriors will finish their regular sea-
son schedule this week with a pair of non-conference
games before turning their attention to post season play.
Norwalk received a first round regional bye and will
play on Saturday hosting the winner of Perry and Greene
County at 7 PM at the Norwalk Baseball / Softball Com-
plex. As a reminder passes are not accepted at any post
season tournament game and admission is $6 K-Adults.
