Page Six N/Warren Town and County News Thursday, August 28, 2014 IJw OFFICIAL PUBLICATION ORDINANCE NO. 374-Z AN ORDINANCE AMENDING THE WARREN COUNTY ZONING ORDINANCE/ ZONING MAP TO RECLASSIFY LANDS WITHIN WARREN COUNTY, IOWA FROM A-1 (AGRICULTURAL DISTRICT) TO C-2 (GENERAL COMMERCIAL- HIGHWAY SERVICE DISTRICT). BE IT AND IT IS HEREBY ENACTED by the Warren County Board of Supervi- SOIl: ARTICLE I. PURPOSE. The purpose of this Ordinance is to amend the Warren County Zoning Ordinance so as to reclassify certain lands within Warren County, Iowa as indicated. ARTICLE I1. AMENDMENT. That the following premises be hence forth reclassified as rezoned to C-2 (General Commercial-Highway Service Dis- tdct) on property described as: Parcel D of the Southwest one-quarter (SW ) of the Northwest one-quarter (NW ) of Section 22, Township 74 North, Range 23 West of the 5 = P.M., Warren County, Iowa, more particularly'described as follows; Commencing at the Northwest corner of the SW 14 of the NW of said Section 22; thence South 000'00" W, along the West line of said SW !4 of the NW 14, a distance of 293.09 feet; thence S 87059'25" E, 57.59 feet to the Easterly dght-of- way line of Highway No. US 65, as presently established, said point also being the Point of Beginning (P.O.B); thence S 87059'25" E, 299.41 feet; thence S 009'1 I"W, 291.12 feet; thence N 8759'25"W, 299.41 feet to said Highway right- of-way line; thence N 009'11" E, along said line, a distance of 291.12 feet to the Point of Beginni_ng, containing 2.000 acres, more or less, and subject to any easements or restriction of record. That the Warren County Zoning Map, indicating the reclassification of the districts, and the Warren County Zoning Ordinance are hereby repealed so as to change the reclassification as set forth above. BE IT AND IT IS HEREBY ENACTED by the Warren County Board Of Supervisors: ARTICLE I.PURPOSE: The purpose of this Ordinance is to amend the Warren County Zoning Ordinance as indicated. ARTICLE I1. AMENDMENT. The amendments are3n Chapter 45 of the FLOODPLAIN MANAGEMENT ORDINANCE THAT WAS PASSED AND APPROVED ON December 23, 2008. The changes are as follows: 45.02 GENERAL PROVISIONS, SECTION B. ESTABLISHMENT OF OFFICIAL FLOODPLAIN ZONING MAP: delete the current wording and replace it with: SECTION B. ESTABLISHMENT OF OFFICIAL FLOODPLAIN ZONING MAP The Flood Insurance Rate Maps (FIRM) prepared as part of the Flood Insurance Study for Warran County and Incorporated Areas, dated October 16, 2014, are hereby adopted by reference and declared to be the Official Floodplain Zoning Maps. The flood profiles and all explanatory material contained with the Flood Insurance Study are also declared to be a part of this ordinance. 45.05 FLOODWAY FRINGE OVERLAY DISTRICT, Section B. PERFORMANCE STANDARDS, #3 Nonresidential buildings - delete: National Geodetic and replace it with: North American. 45.08 ADMINISTRATION, SECTION A. APPOINTMENT, DUTIES AND RESPONSIBILITIES OF FLOODPLAIN ADMINISTRATOR, #2 [C] - delete National Geodetic and replace it with: North American. 45.12 DEFINITIONS, delete the definition for DEVELOPMENT and replace it with the following definition: DEVELOPMENT - Any man-made change to - improved or unimproved real estate, including but not limited to building or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations or storage of equipment or materials. "Development" does not include "minor projects" or routine maintenance of existing buildings and facilities" as defined in this section. It also does not include gardening, plowing, and similar practices that do not involve filling or grading. 45.12 DEFINITIONS, add the definition for MINOR PROJECTS. MINOR PROJECTS-Small development activities (except for filling, grading, and excavating) value at less than $500.00. 45.12, DEFINITIONS, add the definition of ROUTINE MAINTENANCE OF EXISTING BUILDINGS AND FACILITIES. ROUTINE MAINTENANCE OF EXISTING BUILDINGS AND FACILITIES- Repairs necessary to keep a structure in a safe and habitable condition that do not trigger a building permit, provided they are not associated with a general improvement of the structure of repair of a damaged structure. Such repairs include: Normal maintenance of structures such as re-roofing, replacing roofing tiles and replacing siding; B. Exterior and interior painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work; C. Basement sealing; D. Repairing or replacing damaged or broken window panes; E. Repairing plumbing systems, electrical systems, heating or air conditioning systems and repairing wells or septic systems: ARTICLE III. ZONING ORDINANCE. That the Warren County Zoning Ordinance are hereby repealed so as to change the reclassification as set forth above. ARTICLE IV. " WHEN EFFECTIVE.
