Council Member (1-18 thru 12-19) Spring Hill (vote for 4) *Heather Johnson : 0 How to Enforce Immigration Laws 571 193 A federal judge in California has issued an injunction 13 prohibiting the federal government from withholding 672 funds from local governments who refuse to co-operate with federal immigration authorities who are trying to enforce immigration laws. The judge said that the To l president does not have authority to withhold funds appropriated by Congress. Title 8 of U. S. Code Section 1373 provides: 11 o "Notwithstanding any other provision of Federal, State, 1 or local law, a Federal, State, or local government entity or official may not prohibit, or in any way restrict, any 11 government entity or official from sending to, or receiving 11 from, the Immigration and Naturalization Service 12 information regarding the citizenship or immigration 12 12 status, lawful or unlawful, of any individual." 0 The issue is what can the President do to enforce this, 2 and other immigration laws. It is likely that the federal government will appeal to the 9th Circuit Court of Appeals, though that Circuit is the most liberal in the To=, nation and may well side with the District Court Judge.
