NOTICE OF PUBLIC HEARING
The Board of Education of the Norwalk Community School District will conduct
a public hearing in the Eastview 8/9 Cafeteria located at 1600 North Avenue,
Norwalk, Iowa 60211 at 6:00 p.m. on the 8th day of March, 2010 at which place

plans, specifications or contract for, or cost of the Norwalk Secondary Campus
Fine Arts and Stadium Project.

The general nature of said building
construction, improvements and asso-
ciated site work at Norwalk High
School and Eastview 8/9 School is:
1. The construction of a school build-
ing addition totaling approximately
46,000 square feet to serve the per-
forming arts programs. School build-
ing improvements and additions will
include the installation of a 925 seat
auditorium and ancillary spaces and
an instrumental music wing including
two large rehearsal rooms and ancil-
lary spaces, and renovation to current
music classrooms and adjacent
spaces as needed.
2. The construction of a stadium
building totaling approximately 7,400
square feet to service student athletic

awarded the contract, the successful
bidder will be required to furnish a per-
formance and payment bond in the
amount of one hundred percent
(100%) of the contract price guaran-
teeing faithful performance of the con-
tract and guaranteeing payment to all
persons supplying labor and/or mate-
rials in the execution of the work pro-
vided for in the contract.
By virtue of statutory authority,
preference may be given to products
and provisions grown and coal pro-
duced within the State of Iowa and to
Iowa domestic labor.
Work on said project shall com-
mence within ten (10) days of a writ-
ten notice to proceed and shall be com-
pleted by May 21. 2010. Owner will is-
sue notice to proceed after appropri-
ate documentation submitted by Con-
tractor and Construction Permits are
authorized by the Iowa Department of .
Natural Resources (IDNR). Owner
anticipates notice to proceed to be is-
sued approximately March 15, 2010.
Liquidated dama0es in the amount of
Five Hundred Dollars ($500) per day
will be assessed for each day that the
work remains uncompleted after the
end of the contract period. If the Work
is not completed and final payment is
not issued by June 30, 2010, the Con-
tractor will be assessed the sum of
$175,000, due to the loss of State fund-
ing. Bidder specifically agrees that this
assessed sum is a reasonable esti-
mate of the damages incurred by LVA
if the Work is not completed and final
payment is not issued by June 30,
2010. "
Payment for the work will be made
by the LVA in cash from such funds as
are legally available including cash on
hand from a State of iowa Watershed
Improvement Review Board (WlRB)
Grant.
Payment will be made to the con-
tractor based on monthly estimates in
amounts equal to ninety five (95%)
percent of the contract value of the
work completed during the preceding
calendar month, and wi!l be based
upon an estimate prepared by the
Contractor on the first day of the
month, subject to the approval of the
Engineer. Any such payment by the
LVA shall in no way be construed as
an act of acceptance for any part of
the work partially or totally completed.
Final payment by the LVA will be made
in accordance with iowa law and the
contract documents.
